Welcome to the SnapTag App! We aim to give you the best possible experience and make sure you enjoy using SnapTag. To do this, we collect some of your personal data. Your privacy and the security of your data are, and always will be, extremely important to us.
This Privacy Policy explains the details about how DREI Solutions GmbH (referred to as "Service Provider") collects, uses, stores, and shares your personal data when you use the SnapTag App (referred to as "Application"), which is a Freemium service.
"Processing" your data broadly means any action performed on it, like collecting, storing, using, combining, or sharing information.
DREI Solutions GmbH, located at 6300 Zug, Switzerland, is responsible for managing your personal data under this Privacy Policy.
We collect and use your personal data based on specific legal reasons allowed by the General Data Protection Regulation (GDPR).
We collect information you give us when you:
Download the Application.
Sign up for an account.
Use certain features of the app that require your input.
Contact us directly.
This "User Provided Information" can include things like your username, email address, and any content you create or upload, such as photos and text comments. While you don't have to register for basic use, some app features require an account.
As you use the Application, we automatically collect certain technical information. This includes details like the type of mobile device you're using, its unique ID, your device's IP address, your mobile operating system, the type of mobile internet browser you use, and details about how you interact with the app (e.g., which features you access, how much time you spend).
The SnapTag App does not collect precise real-time location information from your mobile device using GPS or similar technologies. While your IP address might give us a general idea of your region (like your country or city), we don't collect exact location data.
We collect and process your personal data exclusively for the following purposes:
Providing and Operating the Application:
Purpose: To create your account, enable commenting, and ensure the app's basic technical operation and troubleshooting.
Legal Basis: This is necessary for the performance of our contract with you (our Terms & Conditions).
Improving and Personalizing the Application:
Purpose: To analyze how the app is used, enhance your experience, develop new features, and personalize the service.
Legal Basis: This is based on your consent for non-essential analytics data (which we will ask for in-app), and our legitimate interests in making the app better for our users.
Charging Fees for Premium Services:
Purpose: To process payments for Premium Service subscriptions.
Legal Basis: This is necessary for the performance of a contract (your Premium subscription agreement).
Communication:
Purpose: To communicate with you about your account, updates, security alerts, important notices, and to answer your questions.
Legal Basis: This is part of the performance of our contract and our legitimate interests in managing our service.
Purpose: To send you marketing promotions.
Legal Basis: This is based on your consent (where legally required) or our legitimate interests (when allowed by law and your privacy rights are protected).
Security and Legal Compliance:
Purpose: To protect our systems and users, detect malicious or fraudulent activity, comply with legal obligations (like subpoenas), respond to enforcement requests, and protect our rights and interests.
Legal Basis: This is necessary for our legitimate interests in ensuring a secure and compliant service, and for compliance with a legal obligation.
By default, the content and data you create in SnapTag are stored directly on your mobile device.
For your convenience and to prevent data loss, we offer an optional premium feature for iCloud backup. If you enable this feature, your data will be securely backed up to your personal iCloud account, managed by Apple's privacy policies.
Your data is only uploaded to our servers when you choose to share content with others through the Application. When you share photos, they are uploaded to Google Cloud servers for storage and to enable core app features, such as processing by artificial intelligence (AI) algorithms for image analysis as part of the sharing functionality. Specifically, if you create a shared tag with AI functionality enabled within the app, any content you add to that tag will be processed automatically through AI as part of its features. This processing is necessary to perform our contract with you (to offer these sharing and AI-driven features).
For certain types of data, especially if the shared content could be considered sensitive personal information or if the AI processing involves profiling, this also relies on your explicit consent.
To build and run SnapTag, we use trusted third-party service providers who work on our behalf and may need to access certain personal data to provide their services to us.
Your data uploaded for sharing and processed by AI is stored on Google Cloud servers located in the Europe West 3 (EUR3) region within the European Economic Area (EEA). However, some of our third-party services, including analytics, payment processing, and crash reporting, may involve processing personal data in countries outside the EEA/Switzerland, such as the United States.

We believe it's genuinely necessary to protect our rights, your safety, or the safety of others, to investigate fraud, or to respond to a government request.
We share it with our trusted service providers who work for us, do not use the information independently, and have agreed to follow the rules in this privacy statement.
We only keep your personal data for as long as it's necessary for the purpose it was collected (e.g., as long as you are a registered user of SnapTag).
If you ask us, we will delete or anonymize your personal data so it no longer identifies you, unless we are legally allowed or required to keep certain personal data.
As soon as there is no longer a legitimate business reason to process your personal data, we will delete it. Any legal obligations to store data remain unaffected.
Under GDPR, you have important rights regarding your personal data. To exercise any of these rights, please contact us at support@snaptagapp.com. We will respond to your request within a reasonable timeframe, usually one month.

We care about keeping your information confidential and safe. We use physical, electronic, and procedural safeguards to protect the information we process and store. For example, we limit access to this information to authorized employees and contractors who need it to operate, develop, or improve our Application. However, please be aware that no security system can prevent all potential security breaches, even though we strive to provide reasonable security.
We may update this Privacy Policy from time to time for various reasons. When we make changes, we will update this page with the new Privacy Policy and change the "Effective Date" at the top of this document. We advise you to check this Privacy Policy regularly for any changes, as your continued use of the Application means you accept all changes.
If you have any questions about privacy while using the Application, or about our practices, please contact us via email at support@snaptagapp.com.
You also have the right to file a complaint with a relevant data protection supervisory authority, especially in the Swiss canton of Zug or in the EU Member State where you live, work, or believe an infringement has occurred, if you think the processing of your personal data violates GDPR.

These Terms & Conditions (hereby referred to as "Terms") govern your use of the SnapTag App mobile application (hereby referred to as "Application"). The Application is a Freemium service created by DREI Solutions GmbH (hereby referred to as "Service Provider").
By downloading, installing, accessing, or using the Application, you are automatically agreeing to these Terms. It is strongly advised that you thoroughly read and understand these Terms prior to using the Application. If you do not agree with any part of these Terms, you must not use the Application.
These Terms, together with any other terms and conditions incorporated by reference (such as the Privacy Policy), constitute a legally binding agreement between DREI Solutions GmbH and each user, whether registered or unregistered, of the SnapTag App. By accessing and using the Application and/or creating a user account, you are deemed to have read, accepted, and agreed to be bound by these Terms.
To use the Service, you must be at least eighteen (18) years old or any greater age required to be deemed to have reached the age of majority under the applicable law of the state or jurisdiction of your residence. By using the Application, you represent and warrant that you meet this age requirement. The Service Provider does not actively verify the age of users.
The Service Provider reserves the right to modify or update these Terms at any time. We will notify you of any changes by posting the new Terms on this page. You are advised to review this page regularly for any changes. Any revised Terms will become effective on the "Effective Date" stated at the top of the revised Terms. By continuing to use the Application after such changes, you accept the new Terms.
The SnapTag App is a mobile application that allows users to upload and share photos which can be processed by artificial intelligence, and to comment on photos or "snaps" within shared tags. You may be required to create a password-protected account to use certain portions of the Service. You are solely responsible for all activity that occurs on your account, and the Service Provider may assume that any activity under your account was made by you. You are responsible for maintaining the security of your phone and access to the Application. The Service Provider strongly advises against jailbreaking or rooting your phone, as such actions could expose your phone to security risks and may result in the Application not functioning correctly or at all.
User-uploaded photos may be processed by artificial intelligence algorithms. This processing is performed on Google Cloud servers. By using the Application, you consent to the processing of your photos by AI on these servers. Data, including user uploaded content, is primarily stored in the Europe West 3 (EUR3) region.
A certain number of features and functionalities are made available to you at no cost ("Free Service"). The features and functionalities of the Free Service are described within the Application. We reserve the right to change or discontinue features and functionalities of the Free Service or move them to our Premium Service at our sole discretion.
In addition to the Free Service, we may provide additional features and functionalities on a subscription basis ("Premium Service"). The features and functionalities of the Premium Service are described within the Application.
You may purchase a Premium Service subscription directly from the Service Provider within our Application, or through a third party, such as the Apple App Store or Google Play Store. When you purchase a subscription through a third party, your purchase is also subject to the terms and conditions of that third party.
When you purchase a subscription directly from the Service Provider, we will ask you to provide a payment method. By signing up for the Premium Service, you authorize us or the applicable third party to automatically charge your payment method on a monthly or yearly basis, depending on the type of subscription you chose. Charges will be made for the then-applicable subscription charge, plus any applicable taxes and fees.
Your subscription will automatically renew at the end of the applicable subscription period, unless you cancel at least 24 hours before the current subscription period ends. The extension period will be for the same duration as the former subscription period (e.g., one month or one year). You can cancel the subscription by following the cancellation flow within the app or, if you purchase your subscription through a third party, by using the cancellation feature of such third party (e.g., Apple App Store).
The Application allows users to upload and share content, including photos and text. By using the Application, you agree that you are solely responsible for any content you upload, distribute, or share through the Application.
You must ensure that all content complies with applicable laws and does not infringe on the rights of others. You agree not to upload, distribute, or share any content that:
Is illegal, defamatory, offensive, or harmful in any way;
Violates any copyright, trademark, or other intellectual property rights;
Invades another person’s privacy or discloses personal information without permission.
The Service Provider does not monitor or assume responsibility for the content uploaded by users. However, the Service Provider reserves the right to remove or restrict access to any content that violates these Terms or is deemed illegal, offensive, or harmful at its sole discretion.
By uploading, submitting, or posting content to the Application, you grant to DREI Solutions GmbH a non-exclusive, worldwide, royalty-free, perpetual, transferable, and sublicensable license to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, publicly perform, and publicly display such content solely for the purposes of operating, improving, and providing the SnapTag App's services and features. This includes, but is not limited to, processing content with artificial intelligence, displaying content in shared tags, enabling comments on content, and for the development and marketing of the Application.
This license will terminate automatically when you delete your content or delete your account, subject to a reasonable grace period for system cleanup and data integrity (e.g., backups, or if the content was shared with others who still have access to the shared tag).
The Application utilizes third-party services that have their own Terms and Conditions and Privacy Policies. By using the Application, you acknowledge and agree to be bound by the terms and policies of these third-party services. The Service Provider does not endorse and is not responsible or liable for such Third-Party Services. Your use of Third-Party Services is at your own risk.
